Is This Being Recorded? An Evening with Former Federal Prosecutor Eric Berg

This presentation will feature Eric A. Berg, litigation lawyer and special counsel with Foley & Lardner LLP, and his explanation of how the U.S. Department of Justice deals with electronic surveillance. The discussion will include an overview of the probable cause required to monitor communications and typical arguments used to attack the government’s decision to use surveillance. Berg will also mention trends associated with surveillance, such as “going dark”, white collar investigations, and international concerns.

Berg is experienced with federal government investigations involving electronic surveillance, foreign corruption, and transnational crime, as well as cross-border transactions, due diligence, capital sourcing, and fund formation. He is a member of Foley’s Government Enforcement, Compliance & White Collar Defense Practice. Prior to joining Foley, Berg served as a trial attorney in the Criminal Division of the Department of Justice. His career with the DOJ focused on the use of electronic surveillance in criminal investigations aimed at the prosecution of organized crime, violent crimes, corruption, the misappropriation of public funds, and drug trafficking.
